Legal
Terms of use
The agreement between you and Knotlog, including purchases in the App Store.
Scope
These terms cover the website, the phone apps and the watch apps of Knotlog. The provider is Philipp Winkler, sole proprietor, Burghof 1, 24939 Flensburg, Germany (details in the legal notice). How we handle your data is in the privacy policy.
What Knotlog is
Knotlog is a private sailing logbook: the watch app records legs, the website shows voyages, nautical miles, harbours, weather and crew and turns them into a mileage proof. The logbook is free. Some features are part of Premium or the Voyage Pass.
Your account
You must be at least 16. An account belongs to one person. Keep your password secret and tell us if someone else has access. You can delete your account at any time.
Your content and the crew
Voyages, notes and photos stay yours. You only allow us to store, process and show them to you while you have an account. Upload only photos you hold the rights to. Add fellow sailors only with their agreement, and tick the box for a name in the proof only if the person agreed.
Right of withdrawal
For purchases through the App Store or Google Play, withdrawal and refunds follow the store's rules; you request a refund there. For purchases in the browser (Stripe), consumers in the EU have the statutory right of withdrawal below. The German version is binding; this English text is a courtesy translation.
Withdrawal notice
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Philipp Winkler, Burghof 1, 24939 Flensburg, Germany, email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you asked for the service to begin during the withdrawal period, you must pay us an amount in proportion to what has been provided until you informed us of your withdrawal, compared with the full coverage of the contract.
Early expiry
Your right of withdrawal expires once we have fully performed the service, provided we began only after you expressly agreed that we start before the withdrawal period ends and confirmed that you lose your right of withdrawal upon full performance (§ 356(5) BGB). You give this consent and confirmation with a tick box at checkout.

Conclusion of contract
The presentation of items in the shop is not a binding offer. By completing the payment process you place a binding order. We confirm receipt by e-mail; the contract of sale is concluded with that confirmation, at the latest when the goods are shipped. Your contracting party is Philipp Winkler, Burghof 1, 24939 Flensburg, Germany.
Made to order
Items are produced only after your order by our production partner Printful (print on demand) and shipped directly to you from the EU. For this we pass your name and delivery address on to Printful (see the privacy policy). Colours may differ slightly depending on your screen and the printing process.
Prices and shipping
The final prices shown at the time of your order apply. In accordance with § 19 UStG no value added tax is charged. Shipping is a flat 4.90 EUR within Germany and 7.90 EUR to another EU country. We only deliver to addresses in Germany and the rest of the EU.
Delivery time
Production usually takes 2 to 5 working days, shipping afterwards 2 to 4 working days in Germany and 3 to 7 working days in the rest of the EU. In total expect about 4 to 9 working days within Germany and 5 to 12 working days to the rest of the EU. These are estimates, not binding delivery dates.
Payment
Payment is made through Stripe and is due with the order; production starts once payment has been received.
Retention of title
The goods remain our property until paid in full.
Statutory warranty
The statutory warranty for defects applies. If the goods arrive damaged or defective, please write to [email protected] as soon as possible with a photo; we will arrange replacement or refund under the statutory rules.
Withdrawal and returns
As a consumer you can withdraw from a purchase of goods within 14 days of receiving them. Details, the model withdrawal form and the rules on costs are in the withdrawal notice. You bear the direct cost of returning the goods. Returns go to: Philipp Winkler, Burghof 1, 24939 Flensburg, Germany.
Purchases through the App Store (EULA)
If you download Knotlog from Apple's App Store, Apple's standard Licensed Application End User License Agreement applies in addition. These terms are between you and us, not Apple; Apple is not responsible for the app or its content. For Google Play, the Google Play Terms of Service apply in addition.
Availability
We work to keep Knotlog available but cannot guarantee it. Track, nautical miles, night hours, harbours and weather are worked out from the watch's measurements; GPS and sensors can be inaccurate or fail.
Not for navigation
Knotlog is a logbook, not a navigation app. It does not replace a chart, a navigation device, a weather forecast or good seamanship. The person in command is responsible for the safe handling of the vessel, the skipper for equipment, weather and route. Never base decisions about your safety on board on the app.
Mileage proof
The mileage proof sums up what is in your logbook. It is not an official logbook or certificate and does not replace the ship's logbook. Whether a charter company or an examination board accepts it is up to them; the skipper's signature confirms the entries, not we. Enter only voyages you actually sailed.
Liability
We are liable without limit for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.
Changes
If we change these terms materially, we tell you by email beforehand. Running subscriptions and passes keep the old terms until the end of the paid period.
Governing law
German law applies. If you are a consumer, you keep the mandatory protection of the country you live in.
